I was referring to patents, I think the situation is similar to MPEG and MP3. 
But looking at the Wikipedia article it looks like you might have problems 
with their reference source code being considered free software as well. 
Maybe there's an independent free software implementation somewhere, kind of 
like Avahi for mDNS/DNS-SD.

It doesn't matter too much to me, however, because I accidentally used it on 
my first trial of the Maemo Recorder software and the quality was horrible. 
With a 1 GB MMC card I don't want to sacrifice anything I don't need to.

I would use vorbis for recording lectures, for sure, but unfortunately my 
portable MP3 player does not support it. :(
