Nokia currently defines what you just said through the
http://maemo.org/legal/terms_of_use.html , that affect also the extras &
extras-devel repositories. [1]

Said that, Nokia hasn't got a team of lawyers watching any new version
released by the community in maemo.org. We don't expect either the
community to be aware of all patents, and specially not encumbered
patents. The story changes when an application approaches official
status, is shipped in the devices, is distributed in commercial terms
and so on. But these cases shouldn't be of your concern in the extras /
extras-devel discussion, really.
