I am confused about the current source code situation with the new OS release. 
From a quick read of the kernel source thread it appears that the kernel 
source for the new version is not available. Wouldn't that be a GPL 
violation?

Either way, people seem to have had success with using the old kernel source 
to compile kernels for the new OS, so you should be able to use the old 
config as a starting point at least (arch/arm/configs/n770_defconfig).
